Fisherman Files Lawsuit Against Helmsman Of Yacht Who Crashed Into His Boat

Bryan Maess, Christopher McMahon and Roni Durham, were lucky to be alive after a 31-foot boat crashed into their 20-foot fishing boat last summer. The scary crash was caught on their GoPro camera and shows the three men frantically waving their arms as a boat, piloted by  Marlin Lee Larsen, speeds toward them. They managed to jump off the boat at the last second and avoided serious injuries. 

Maess, who has not been back on a boat since the crash, has filed a lawsuit against Larsen for $372,500, according to Fox News. He claims to have "vision problems, headaches and injuries to his ankle, leg and arm from the crash." 

Following the crash, local authorities charged Larsen with "Reckless Operation, 3 counts of Recklessly Endangering and 3 counts of Assault in the 4th degree." According to The Oregonian, the 75-year-old told authorities that he was unable to see where he was driving because he was sitting down and unable to see over the dash of the boat. His son-in-law told authorities that Larsen had been using his cell-phone while driving the boat. 

Larsen pleaded not guilty to the charges, and the criminal case is on-going. 

The other two men have not filed lawsuits yet, but have hired attorneys, and plan to file one soon.
